Recent advice on the EU Directive on empowering consumers for the green transition
Last week, the Special Advisory Committee on Consumption (‘BRC Verbruik’), a Belgian advisory body, published its advice on the implementation of Directive 2024/825 into Belgian law. This directive aims to better inform consumers and protect them from misleading practices, enabling them to make more sustainable choices.
This advice highlights several key concerns for practical implementation, such as:
• 𝐑𝐞𝐬𝐩𝐨𝐧𝐬𝐢𝐛𝐢𝐥𝐢𝐭𝐲 𝐟𝐨𝐫 𝐢𝐧𝐟𝐨𝐫𝐦𝐚𝐭𝐢𝐨𝐧: Who is responsible for providing the required information if the manufacturer fails to do so?
• 𝐋𝐢𝐚𝐛𝐢𝐥𝐢𝐭𝐲 𝐟𝐨𝐫 𝐢𝐧𝐜𝐨𝐫𝐫𝐞𝐜𝐭 𝐢𝐧𝐟𝐨𝐫𝐦𝐚𝐭𝐢𝐨𝐧: Who bears liability if the manufacturer’s information, passed on in good faith by the seller, turns out to be incorrect?
• 𝐓𝐫𝐚𝐧𝐬𝐢𝐭𝐢𝐨𝐧 𝐩𝐞𝐫𝐢𝐨𝐝: What happens to products placed on the market or already in stock before 27 September 2026, the date from which the rules apply?
Although the BRC’s advice is non-binding, it will serve as a reference for the legislator when transposing the directive into Belgian law.
