Updated bill for new Book 7 of the Belgian Civil Code submitted in Parliament: important changes
Yesterday, an updated proposal regarding the new Book 7 on specific contracts was submitted to the Belgian Federal Parliament. Following a public consultation in October, the proposal has undergone significant changes.
A notable change is the proposed amendment of article 5.80 of the Civil Code (in Book 5 of the Civil Code, which already entered into force on 1 January 2023). According to the proposed amendment, risk will no longer pass upon the transfer of ownership, but rather upon delivery.
