Vertical restraints are back on the enforcement agenda
We are pleased to share that our partner Filip Tuytschaever, together with Yvo De Vries and Mika Hermans, has published an article on the renewed enforcement of vertical restraints in Belgium and the Netherlands.
Published in a joint issue of the Belgian journal Competitio and the Dutch journal Mededingingsrecht in de Praktijk (MP), the article compares recent developments in both jurisdictions, including resale price maintenance, online and territorial sales restrictions, selective and exclusive distribution, and territorial supply constraints.
The article highlights how Belgium and the Netherlands apply a largely common European framework, while differing in terms of national guidance, enforcement intensity and priorities.
