Important legal update for franchise agreements in the food retail sector
A new Royal Decree impacting franchise agreements and other commercial collaboration agreements in the food retail sector has been adopted. The Decree adds to the ‘black’ and ‘grey’ clauses applicable to B2B agreements – a list of clauses that are (deemed to be) unlawful pursuant to articles VI.91/4-5 of the Belgian Code of Economic Law.
Franchise agreements in the food retail sector will require thorough review to ensure compliance following the entry into force of the Decree. Take a look at the slides below for more information on the new black- and grey-listed clauses. 👇
The Decree demonstrates that franchising remains a hot topic in Belgium. Be sure to check our previous post on precontractual information obligations 🔗https://lnkd.in/dcQDafKC
